F. Saborit Mahón
The High Court of Justice of the Balearic Islands (TSJIB) has dismissed the judicial review filed by the association of farm owners Meloussa and the Association of Farm Menorca (AGRAME) against the whole of the Island Council agreement, Day 25 April 2003, which adopted the Plan Territorial Island (PTI). As in the other nine judgments resolved on the standard of planning, the TSJB understands that the Consell de Menorca has the ability to classify soil with new categories of protection, such as the Territorial Areas of Interest, "in response to interest dues and taking into account that this is a general management tool.
One of the arguments used by Meloussa and AGRAME on the invasion of municipal powers by the PTI, is invalidated by the high court, where sentences and others have emerged on the conflict between the municipal and regional planning, usually autonomous. This effect refers to the consolidation of the institutions of government Consells on each island, while local governments are, and says the issue to them (Law 14/00) the development and adoption of spatial plans, not ceñirían development of the law but "taking it as a reference operate as derivative, but general and far from land." The High Court of Justice of the Balearic Islands concluded in its ruling that "the territorial nature of the island have cornerstone of the autonomous land."
